Nokian Heavy Tyres limited warranty
These terms of liability cover raw material and manufacturing defects of the products (“Products”) made by or for Nokian Heavy Tyres Ltd (“Nokian Heavy Tyres”). The liability remains effective for three (3) years from the date of purchase of the Product or for five (5) years from the manufacture of the Product, whichever is the earliest.
If a raw material or manufacturing defect is detected in the Product in the Nokian Heavy Tyres´ inspection, Nokian Heavy Tyres shall be liable for this defect in accordance with these terms of liability.
These terms of liability shall not apply to sensors manufactured by or for Nokian Heavy Tyres. These terms of liability shall not apply in the following cases:
a) normal wear and tear;
b) incorrect use or use against the given instructions;
c) use in car racing or other such exceptional conditions;
d) incorrect mounting on rim by a party other than Nokian Heavy Tyres or its authorized contractor;
e) incorrect storage of the Product by a party other than Nokian Heavy Tyres or its authorized contractor;
f) incorrect studding implemented by a party other than Nokian Heavy Tyres or its authorised contractor;
g) alterations or repairs of the Product conducted by a party other than Nokian Heavy Tyres or its authorised contractor;
h) damage caused by other party than Nokian Heavy Tyres or its authorized contractor, such as damage caused by transport or mounting;
i) damage caused by chains or other accessories;
j) incorrect or incomplete information or instructions given to the customer and not confirmed or approved by Nokian Heavy Tyres; or
k) other issues comparable to those mentioned in paragraphs a)–j) that are beyond Nokian Heavy Tyres’ scope of influence.
Notwithstanding the aforesaid regarding the validity of Nokian Heavy Tyres’ liability, these terms of liability apply only as long as the defective Product’s groove depth fulfils the statutory requirements of the country of sale.
In order for Nokian Heavy Tyres’ liability to apply, the customer must notify Nokian Heavy Tyres or its authorised dealer of the defect immediately and not later than within two (2) months from detecting the defect or from the moment when the defect should have been detected. The customer must immediately return the Product it considers to be defective to Nokian Heavy Tyres or to its authorised tire dealer. Nokian Heavy Tyres shall examine the Product. The Product that is found to be defective shall not be returned to the customer. Nokian Heavy Tyres reserves the right to use any data regarding the use of the Product generated by Nokian Tyres´ digital services, with which the customer has registered, in the warranty claim processing.
Defective Product shall be replaced with a similar Product that is free from defects. The customer shall, however, compensate to Nokian Heavy Tyres the difference between the price of the new Product and the unrealized benefit from the use of the returned Product (realizable had the returned Product not been defective). The price of the new Product delivered to the customer shall be the price valid at the moment, when the defective Product shall be replaced to a similar new Product based on these terms of liability. The unrealized benefit shall be calculated on the basis of the remaining groove depth and/or utilization time of the Product. When calculating the unrealized benefit of the defective Product, the price of the defective Product shall be considered to be the price evaluated by Nokian Heavy Tyres at the moment of return of the defective Product and according to the market price of the Product of the same model, size, and type in the country in which the Product in question was sold.
To the raw material or manufacturing defects of integrated products, for instance studs, the terms of liability of the manufacturers of these products shall be applied.
Nokian Heavy Tyres shall not be liable for any damage, and these terms of liability shall not apply, in cases of force majeure or other issues beyond Nokian Heavy Tyres’ scope of influence.
Nokian Heavy Tyres’ liability shall be limited to the aforesaid, and shall only be valid as stipulated in these terms of liability. Nokian Heavy Tyres shall not under any circumstances be held liable for any indirect or incidental damage, loss of business income or other profit or any other economic damage, or for any damage caused by the inability to use the Product.
What is stated under this Limited Warranty applies equally to the sale of Products by any other company belonging to the same group of companies with Nokian Heavy Tyres. These terms of liability shall be governed by and construed in accordance with the laws of Finland. These terms of liability shall not limit the customer’s rights under the local mandatory law.
